Lieutenant Steve Cappas & Deputy Zach Ward were deposed in the Rogers vs. Morgan civil case. Under oath, both ECSO employees contend evidence was not properly stored in a secured location and reports were missing from case file.
Zach Ward, the first of the two to be deposed, says that chain of evidence was in tact up until the reports he created on the composition of Leah Manning’s devices in this sexual abuse case. In review of the case file, it becomes obvious the reports Ward claim to have run on the evidence he received in 2015 were not in the case file but a second examination of the phone of Leah Manning had been inexplicably run over a year later and was in the file where his report should have been.
In Lt. Cappas’s deposition, this is what he says about storage of evidence
When asked where Leah Manning’s IPad is, Cappas replied
Cappas was asked about the fact Morgan’s number was in Leah’s phone and the veracity of the statements made by Morgan in his press conference
When Cappas was asked about my blog publishing that Leah had the Morgan’s number

How could you “have gotten it from anybody” when he made the claim he was the only one with access to the evidence? And then he confirms the fact the number was in there…… nice!

That is some really really amazing circular logic there. From reading this, “Covering for his boss” is about the most obvious thing I read. This deputy could not figure out I was the only person in possession yet this information got it then it must have been him.

So the phone number was there—record of texts and times dialed– can they produce those– from the FIRST report. You know, after Morgan said on March 9 2015 press conference they have 100,000 images to go through.

Supposedly that should be in the reports. But the new one probably has less info than the first.

No it’s not obvious it was him that reported it to CJ, It’s obvious the records were not secure. that comment was “indefensible”

You’re right. When you have a case with numerous self-interested people possibly implicated in criminal acts or being caught having sex on duty, FDLE should have taken the case over.

When is another entity going to step in on this case?? We are leaving everything in the hands of the accused, hardly seems ethical, logical, professional or anything less than criminal. I hope if Im ever accused I get to handle all my evidence and everything – how handy would that be??

There is a lot of mistakes that were made during this investigation! The fact that it was not passed onto FDLE or another Law enforcement agency was the biggest mistake. The fact that Ricky Shelby’s name was in the phone was left out of the depo (from what I read). Shelby was OIC of investigations during all these! I will say that Zach Ward and Steve Cappas are good ethical cops who have been placed in a bad position.
