Last week, as many people know, James Scaminaci endorsed a post of mine on FB-Escambia Citizens Watch. I have been blocked from that group so I did not see any of this unfolding until I looked at through a friend’s FB login. I only went there to get a copy of the shifty little degree Morgan claims is an MBA after Webster UNIVERSITY told me they had no record; technically that was true. He doesn’t have an MBA and he had the year wrong as well as the name of the institution–WEBSTER COLLEGE. While it is the same place, for the purposes of quality assurance, that fact may have been one of the issues in verification as it was prior to a major shift from college to university–a watershed moment in their history, but I digress.

In looking at the posts of the unfolding of this whole thing, I became very aware of the cattiness of community. I posted a correction, but the group does not acknowledge that. It is made to look like James corrected me while, in point of fact, he was correcting himself. This fact is not seen, but I suppose I didn’t expect it to be. You see, this “free speech” group doesn’t allow me to see any of this.  To clarify, James did not “catch me” in  a lie, nor did he do anything extraordinary as he talked to the same person but received a different answer to the same question for reasons that are not clear.  While I acknowledge and corrected myself, the “free speechers”, led by Richard White and David Craig mocked me and my blog. They talked about me as if I was someone who fell off the turnip truck in a crazed vendetta against Morgan, after being dismissed by reliable people like Rick Outzen and Little Dickie White, while I compulsively talk about the Billings’ Murders.

Usually what other people say about me I regard as none of my business, however, I am regrettably disappointed by my peer, James Scaminaci for his part in this. He posted this in a place where I could not defend myself or do anything to accurately portray the circumstances. He misstated that Morgan’s degree of an MBA was verified as it was not. I was correct in my wording and I stand by it as such.

Also, I wanted to address the postings and comments of the peanut gallery.  I am involved in the Pensacola political arena because I am interrelated to the area, the people and the issues. It is my hometown. Most of my friends live there still. My “obsession” with the Billings’ case is even more basic. I am human. In my own curiosity over this case–AS IT UNFOLDED–I educated myself with the facts of the case as I was taking predominantly criminology classes at Eastern Michigan University from men who have LEGITIMATE DEGREES FROM NAMED SCHOOLS, who have wrote books on the subject and even presided over national-interest cases. When I didn’t find one shred of real evidence that someone I knew, Patrick Gonzalez Jr, was guilty, as a human I could not sit by idly and watch him be put to death for a crime he did not commit. We are all interrelated in mutuality on this Earth, so whatever injustice is done to one, it is done to all. That is an assertion made by our founding fathers as well as Martin Luther King Jr. in his “Letter from Birmingham Jail”. “Injustice anywhere is a threat to justice everywhere”.

In that understanding, I have used my time to research this case because it means something to me.The problem doesn’t just appear in this case. I assert that it is a systematic breakdown in the justice system everywhere. A death penalty case started and completed in 3 days is one fact that says it all. How could this elaborate case be reduced to 3 days when the question of life or death is involved?  What justice could that possibly entail? Two co-conspirators saying he did it to protect their self-interest and the confession of a mentally ill man who did not immediately confess but did so off the record after 3 days of being held without proper representation or medication; he was legally not able to make the confession they based the case on because of his mental impairment. You wouldn’t have a child under the age of 13 testify after being held without communication with a legal guardian, so why would you hold a mentally incompetent man without a lawyer for 3 days?

There is a feasting on the weak in this case. Young African American boys who confessed after being told they would receive the death penalty if they didn’t testify and a mentally handicapped and impaired person held, without medication, who makes some impromptu confession (unrecorded) to Bill Eddins directly.  This man was held for 2 years without a plea deal as leverage over the other men in custody until they were adjudicated. This man lost his life over this.  He died in prison of malnutrition from improper treatment of throat cancer.

NONE OF THIS IS RIGHT. So I use my time to try to make a difference.

Escambia Citizens Watch, I say, shame on you for not seeing what you should have seen right in front of you. Morgan is a FRAUD. EVERY CASE HE TOUCHED SHOULD BE REINVESTIGATED.not a sheriff

Finally to all involved in this little clique of gossip and misinformation, I say FUCK YOU. Read a book or invest your time into something substantial. Prove me the fuck wrong… Oh and by way, got something to say? By all means, say it to ME.

CJ’s Street Report Questions 3rd Term for Morgan

On February 11, 2016, Sheriff David Morgan posted a political campaign video on YouTube.  In the final minutes, from 28:45 to 29:15, Sir David explains why he is seeking in a third term, despite the fact that he supposedly believes in term limits and that people serving a third term usually lose touch with reality.

On February 4, 2010, Sheriff Morgan told a community group, “…monopoly money, you lose touch with reality if you are spending other people’s money; so that’s why I’m a big advocate of term limits, of term limits.  I would love to do a second term as the Sheriff of Escambia County.  But let me make this statement to this group as I make to a lot of these groups.  I believe in term limits from the top of my head to the soles of my feet.  If I go stupid and run for a third term, do not vote for me; do not vote for me because you need to cycle people out of these positions.  I need to go back to the business world and understand what it is to balance a checkbook and make payroll, put children through college…”

Here is Sheriff Morgan’s exact quote taken from his February 11, 2016 political advertisement:

“I will tell you now in running for this third term it was a difficult decision for me to make.  And I made that decision because of you; because of you.  Because I see those in our community who want to take us backwards and not forwards.  And some of the candidates that are coming up to run now.  And I encourage you to check out their backgrounds; to check out their backgrounds.  And when you do, you are going to find out why David Morgan changed his opinion and understood that it was his duty to run for another term.”

COMMENT:

The assertion by the Sheriff that he is running for a third term because of the “candidates that are coming up to run now” suggests that Sheriff Morgan has already lost contact with reality.

According to indisputable proof from the Escambia County’s Supervisor of Elections, Sheriff Morgan filed to run for a third term on January 13, 2014.

That was 388 days before Doug Baldwin, Sr. filed to run for Sheriff.  And it was 567 days before former Sheriff Ron McNesby filed to run for the office.

Are we to believe that Sheriff Morgan could look into the future and see 388 and 567 days ahead regarding the character and qualifications of candidates who had not filed to run for Sheriff?  Is Sir David a soothsayer?  A clairvoyant?  A fortune teller?  If he can see that far ahead regarding his political opponents, why does he not stop crime like in the Minority Report?

And when Sheriff Morgan smears the other candidates, what exactly does he have in mind?  What is in their backgrounds?

Doug Baldwin, Sr. is a decorated former Pensacola Police Department officer with assignments in Special Weapons and Tactics, Criminal Investigations, Special Operations, Narcotics Unit, and Department of Homeland Security Protection Liaison.  John Johnson is a decorated former Drug Enforcement Agency special agent.

Sheriff Morgan, on the other hand, has zero first-hand experience working as a criminal investigator, or a narcotics investigator, Special Weapons and Tactics, or Special Operations.  When you look into his professional background before he became Sheriff, he rode a desk in the rear echelon.

So why is Sheriff Morgan running for an unprecedented third term as Sheriff of Escambia County?  Maybe the answer is that Sheriff Morgan decided to break his pledge not to run for a third term because: (a) he can and/or (b) because the local powers that put him into office in 2009 are getting a good return on their investment and want to keep him around.  In other words, is it possible that Sheriff Morgan has now become the political machine he decried in when he ran in 2008?

I agree that Doug Baldwin and John Johnson have better credentials to be Sheriff. I like them both. However, when asked to look at issues that are present now, like the corruption of the position now. Doug Baldwin and John Johnson both said “I can’t do anything until I’m elected.” THAT IS A COPE OUT.

The next Sheriff needs to go to the people and ask them what they need. People like Cindy Cutting and Chris Rogers who have teenage kids who are forever changed by Sheriff Morgan’s status quo.

Doug Baldwin asked me,

” What do you want from me. I have made it perfectly clear that I am against corruption in our community at any level. What else is there to say. I also said that I support your advocacy. So what is it you want me to do. I can’t do anything until I get in office and hold those accountable to the wrongs to this community.what do you want me to do?”

I believe you, as a representative or potential representative of Escambia people, go to the people and create a strong voice against the machine. Neither are willing to do so.

I also asked each of them to put a signature on a anti-corruption pledge. A symbolic measure to be sure, neither would put their John Hancock on a pledge to end corruption within their community. That is striking. Both were almost insulted by the challenge but considering the current state of Escambia County, it is a very reasonable request. “The Morgan campaign strategy was simple. ‘We made no secret that I was going to stand in front of people and tell the truth about the administration of this sheriff. I knew if we could get the information in front of enough people we would win,’ says Morgan. ‘We needed to communicate effectively that McNesby’s record needs a second look.'”

When I read this, I have to admit, I laughed out loud. Morgan has never stood up in front of ANY administration and told the truth about anything.  As we already substantiated, he lies on pathological basis. He claims any number of things including his own belief in term limits & not to elect him, should he go “stupid”, yet he then contradicts himself or flat out succumbs to arrogance and runs for a third term.

Sir David claims that McNesby’s record needs a second look, while his record shows that he gives ill-equipped officers guns to put 16 bulletholes in an unarmed suspect and his vehicle for reaching for a cigarette; he also infamously made newspapers for being ill-informed and arrogantly making broad, generalizing statements like “it’s witchcraft” or that Muslims are like Nazis. That is his record.

His fiduciary accountability is questionable in that he donated money that is not his in return for monies funneled into his campaign like Brownsville; this is researched and documented by CJ’s Street Report.

So while McNesby had questionable ethics, Sir David has far exceeded him in that race. His minion David Craig even eluded to the fact that Morgan stole the election over McNesby.

In the same article mentioned above, this is another excerpt that is curious:

‘”We went into the election day knowing that we were going to win by 10 points or more,’ David Craig interjects. The actual margin of victory was 13.4 percentage points, or 3,211 votes. In the 2004 Republican primary, McNesby beat Morgan by 34 points.”

How could anyone possibly know they were going to win going into election day? Or exactly what the spread would be?

McNesby may have done some unethical things but it appears Morgan’s first official criminal act was manipulating election results.

Sir David is the King of Contradiction, or Hypocrisy, Flip-Flopery, if you like. When he gets questioned about something he said, his favorite excuse is “I did not say that” or “What I said was taken out of context”. That within itself shows the lack of responsibility for words he careless uses regarding that come back to bite him in the ass.

    When Sir David filed for Sheriff, I had to laugh, because he spoke to the Pensacola Biz Net Aug 4, 2011  & he made the following statement:

“I believe in term limits from the top of my head to the bottom of my feet….. There are conflicting reports this morning as to whether or not the DEA has become involved in the Billings murder investigation.

“As Escambia County Sheriff, I have no knowledge of any DEA involvement in this case,” David Morgan said Wednesday night. “I have not spoken to any representative of the Drug Enforcement Agency today.”-CNN

But CNN was reporting early Thursday morning that the DEA was on the case. CNN quotes a DEA spokesman in Miami, David Melenkevitz, as saying that the Escambia County Sheriff’s Department did call for the DEA’s assistance.

David Melenkevitz, a spokesman for the DEA, said his agency is assisting with the investigation but would not comment further. He said Escambia County officials have also sought help from other federal agencies including the FBI and the Bureau of Alcohol, Tobacco, Firearms and Explosives. —CBS News  July 16, 2009

Even Sir David’s repeater (not reporter), Rick Outzen, who has claimed that Sir David is the best sheriff Escambia County has had in years wrote this:

It has been a week since Bud and Melanie Billings were killed. The seven men who the authorities believe are responsible and one female accomplice have been arrested. The media wants to know why, what was the safe taken from the home and why are the FBI and DEA possibly involved.

CNN is reporting early Thursday morning that the DEA is on the case, despite denials by Sheriff Morgan the prior night on Anderson Cooper 360. They say that David Melenkevitz, a DEA spokesman in Miami, has said that the Escambia County Sheriff’s Department did call for the DEA’s assistance.– Rick Outzen, Rick’s Blog, July 16, 2009

Now if this is a humdinger as Sir David had claimed and the alphabet soup (FBI, ATF, FBI & Homeland Security) were participants, then Sir David may not be the BIGGEST LIAR IN ESCAMBIA COUNTY (He’d still be in the top 10, if not the top 5). Here’s why I say that, they actually responded.  Now anyone can call these agencies and ask for assistance, but they may not actually show up. But there are credible sources saying, as early as 1 week after the murders that the DEA was brought in, contrary to Morgan’s statement.  There appears to be solid reasons that the DEA was a participant in this case.

 To end speculation, I have proof of their involvement.

 Corroborated by an FBI source, there were 2 ACTIVE DEA investigations into Byrd & Melanie Billings at the time of their murder. DEA only gets involved on high level drug cases. They don’t show up for insignificant possession/personal use cases where there is no chance of trafficking. Their presence speaks for itself and is contrary to Sir David’s version of events.

*Also, these DEA cases, one initiated in 2005 and the other in 2007, are still, TODAY, active investigations.

Think about that for a moment.

3.  Super Predator/ Thug Culture is the Downfall of America

“I take issue with the time African Americans. We are Americans…The blacks that currently reside in the United States are not from Africa. Those sorts of terms society has chosen to use are divisive in nature. So what are the issues in the minority organizations within Escambia County? Many are real and many are perceived. I will tell you I think many are perceived. Here is why, again, let’s go back to the history of our nation and where we are today. Not that many years ago, the thought of electing an African American president would have been unthinkable in the United States of America. I would remind African American’s that you are a little over 13% of the entire population of the United States…..If those 13 % were the only ones that voted for President Obama, he would not have won that election….the statistics are if we are such a racist nation, why do we currently have an African American president?”

When asked for a response to the assertion that racism is merely a perceived social problem, Sir David responded with a statement to Channel 3 WEAR that his comments were taken out of context and  that those who propagate information about his rant have “a motive”. 

And the best statement ever out of his mouth:

I challenge someone to find an incident where anyone could have said that I am racist.”

The irony is every word he said prior to that statement is a jab at every ethnicity. He uses statistics to belittle the African-American people and remind them they are but 13% of the population. You can add hypocrite to his tile of racist.

In the wake of two Escambia County Sheriff’s Office deputies firing 15 bullets at Mr. Roy Middleton in late July 2013, which created a national story, Sheriff Morgan delivered prepared remarks before the Rotary Club of Pensacola.  The Pensacola News Journal carried the Public Information Office’s edited version of the Sheriff’s remarks.

Sheriff Morgan:  ‘Muslims are Nazis’

At the 3:45 mark of the uncut version that the Street Report came to possess, Sheriff Morgan, after recommending to his Rotary Club audience reading Winston Churchill’s three-volume memoirs, Sheriff Morgan stated the following:

“And what you’ll find striking, and I find striking by the way, is the policy of appeasement that we go through in an almost a cyclic mode through our communities and our societies.  An appeasement across the board.  We intend to appease crime; we intend to appease political opponents; we intend to appease those who have different religious beliefs than we do.  And the frightening thing about these volumes is this, if you changed NAZI to Muslim, you’ll have a terrific eye opener…”

5. Triple Murder of the Smith Family

In a press release, 5 days after the bodies were found and all news was hushed, Sir David made this eloquent statement regarding the brutal murders.

“It’s witchcraft, I’ll say that right now. The method of the murder, blunt force traumas, slit throats, positions of bodies and then our person of interest has some ties to a faith or religion that is indicative of that. Those of you that follow any of that will also note that at the time of death we believe on Tuesday it also coincides with what’s referred to as a blue moon, which occurs every three years.”

In response to that ignorant statement, every Wiccan, homeopath, occult personality came forward to refute this statement of “witchcraft”. I contacted Michelle Belanger, occult expert, known for her work on “Paranormal State” as well as her writing on the subject. When I spoke to her she was baffled how a person of Sir David’s authority and assumed intelligence would make such a reckless statement. She made 2 videos for YouTube regarding Sir David.  Here is a bit of what she had to say:

 “The biggest problem in Pensacola right now is you got a Sheriff who is jumping to all kinds of conclusions. He’s creating his own kind of red herrings. …My other problem with Sheriff Morgan is, your average person doesn’t know what a Wiccan is, doesn’t know what a Pagan is. They hear these words from an authority figure, like Sheriff Morgan. What he is doing, either through his own ignorance or his own willful misdirection of the actual facts of the case. He’s betraying the trust that people have put into him……..He is misleading people who he’s their only source for whether or not that’s true. And because he’s seen as an authority figure, they are not going to go out and Google to find out that he’s actually talking out of his posterior in a grievous way that could honestly incite hate crimes.”

Sir David’s response: “It was a misconception.”

**Sidenote: Morgan claimed the family was reclusive and that hampered investigation. When WKRG Channel 5 out of Mobile interviewed the Smith Family about the witchcraft factor, the family denied there was anything suggestive of Blue Moon or witchcraft based on the information given to them. They also refuted Morgan’s claim of the family being reclusive.**

The fact in this murder is that one of the sons is a cybercrimes expert at Homeland Security. Sir David said that they KNOW that fact wasn’t the motive for murder. He still says that theory was still “in play,” but that his office had also investigated financial gain and Richard Smith’s connection to the Department of Homeland Security as possible motives.

Specifically, the way he phrased it in an exclusive with WEAR-TV 3’s Amber Southard, who is now his new Public Information Officer that out earns most lietenants at the ECSO, was there were three possible motives: National security, witchcraft, monetary gain. Two are still on the table, as there were no national security implications involving the death of 49-year-old Department of Homeland Security employee Richard Thomas Smith.

 No chance that he’s wrong on the Homeland Security angle  but witchcraft is possible?

It hurt my head to even put that sentence together.

Sir David has many more loosy goosy “out of context”, “misunderstood” or “wrong perception” excuses. This is just the highlight reel, folks.

Sheriff Morgan uses the Law Enforcement Trust Funds for many reasons.  He apparently provides funds for deserving organizations, like the $50,000 he provided to Gulf Coast Kids House, which cares for abused children, to expand the facilities because they were operating at twice their operational capacity.

Or, sometimes he gives money to the haves so that they have more, like the AFCEA Blue Angels that received $20,000, on March 3, 2015, according to the Law Enforcement Trust Fund expenditures given to CJ’s Street Report’s public records request.  Or, the $15,000 Sheriff Morgan gave to the National Flight Academy after he gave he speech there.  The donation was made on March 25, 2014.

Or, he gives money to his ideological allies in the Christian Right in Pensacola.

Like the $10,500 he gave to the Assembly of God’s Teen Challenge, also known as the Pensacola Men’s Center, for “drug treatment” that is a cover for outright Christian proselytizing.

Like the $5,000 he gave to the Men’s Barn Meeting which functions as a networking hub linking Baptist churches in the local area to Southern Baptist Convention leaders in the Christian Right.

Like the $7,000 he gave to the Alabama-based Youth Reach Gulf Coast, despite the organization not having provided any services to any youth or young man from Escambia County, Florida.

When advised by Americans United for Separation of Church & State that these specific donations violated the U.S. and Florida constitutions, the response of the Sheriff’s Office was that they were not going to respond to the Americans United’s legal inquiry.

Or, he gives money to worthwhile causes and the person receiving the Law Enforcement Trust Funds then later makes a donation to Sheriff Morgan’s re-election campaign, as happened when Sheriff Morgan authorized a rapid donation of $1,000 for the non-existent Light the Night Foundation (in reality the Alabama-based Leukemia & Lymphoma Society with no business license in Florida) that was delivered to Pete Moore.  Pete Moore and his wife later made two $500 donations to Sheriff Morgan’s campaign.  Pete Moore gives to Republican sheriffs and candidates, so the $1,000 donated from the Sheriff’s Office is not a factor.  But, it does not look good.  While there is no quid-pro-quo here, it is amazing the Sheriff can write a donation check to a non-existent foundation.

And, now we have Sheriff Morgan’s re-election campaign using the property owned by the Filipino-American Association of Pensacola, Inc., a 501(c)3 organization for his fundraising event on September 26, 2015.

Not only is the Filipino-American Association a 501(c)3 organization that is prohibited from engaging in politics, but in 2014 it received $7,000 in two donations:  $2,000 on May 28, 2014 (reference V10719) and $5,000 on August 26, 2014 (reference V11991).  CJ’s Street Report has a public records request for all the documentation, plus any donations made to the Filipino-American Association since October 1, 2014.

Again, while there is no quid pro quid, we find the same pattern of Law Enforcement Trust Funds going to an organization that, in turn, provides a venue for a fundraising event tapping its own members for donations.

Thus, while there is no doubt that the Filipino-American Association does fine work in the community and has been recognized by the county and state officials for their good works–as evidenced by the plaques expressing support on one of the walls of the hall–the fact is the organization is prohibited from engaging in political activity.

Here is the Internal Revenue Service’s guidance on political activity:

“Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office. Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity.  Violating this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise taxes.”

Thus, a 501(3) organization is “absolutely prohibited” from “directly or indirectly participating in, or intervening in, any political campaign.”  There really isn’t much wiggle room to “absolutely prohibited” and “directly or indirectly.”  How Sheriff Morgan convinced them Filipino-American Association to violate this IRS guidance is a mystery.

CJ’s Street Report attended the fundraising event for a very short time.  Upon my third entrance, Deputy Chief Haines congratulated me for my “valiant attempt” to attend the fundraising event, but I was informed it was a “private function” and I was not welcome.  However, before being graciously and humorously turned away, I did manage to take photographs of the event and keep my receipt.

Although my check was returned, I kept the receipt.  The receipt reads, in part:  “You are cordially invited to a candidate Fundraiser to re-elect David Morgan For Escambia County Sheriff….Hosted by Virgil Domingo and Friends AT the FilAm Center, 234 Oakfield Rd, Pensacola, Fl.”

Sheriff Morgan’s website invitation to the event begins, “Back by popular demand…Karaoke fundraiser on September 26th.  Besides Karaoke, there will be dancing, socializing, and Filipino Food.”

Now, Karaoke night just happens to be one of the Filipino-American Association’s fundraisers, according to Form 990s filed with the Internal Revenue Service.  In 2011, Karaoke brought in a net of $2,193.05.  In 2012, the Filipino-American Association spent $3,100.95 on Karaoke equipment and tables, and brought in a net of $2,144.06.  In 2013, Karaoke night brought in a net of $1,084.25.

Thus, when Sheriff Morgan’s invitation exclaimed, “Back by popular demand…Karaoke fundraiser,” he was clearly referencing an annual fundraising event put on by the Filipino-American Association that over the past three years had netted the organization $5,421.36 or an average of $1,807.12 per year.  Except this year, checks were to be made payable to the “Re-elect Morgan Campaign.”

Why would Sheriff Morgan not do his due diligence and recognize that giving at least $7,000 to a non-profit corporation and then having them host via their own venue a campaign fundraiser would not raise questions, and, why would he not consider what effect, if any, that campaign fundraiser would have the Filipino-American Association’s tax-exempt status?

One possible answer is that Sir David Morgan simply does not believe that the U.S. Constitution, the Florida constitution, and Internal Revenue Service regulations apply in Pensacola.

Another possible answer is that the officers and board members of the Filipino-American Association (as reported on the 2011, 2012, and 2013 Form 990s) have personally donated to Sheriff Morgan $1,740.  Thus, he may have deliberately targeted the Filipino-American Association’s board and officers for the fundraiser knowing that they personally support his candidacy and might not consider the possible ramifications.

One last observation, apparently, this hyphenated name, Filipino-American, does not upset Sheriff Morgan as the term “African-American” to him is dysfunctional and “divisive.”
